Four Companies Call on DRC Head of State to Restore Legality on SAKIMA-Primera Gold Contract
Four partner companies of SAKIMA are making an urgent appeal to the President of the Democratic Republic of Congo, expressing their concern over what they describe as “enormous litigation” resulting from the recently reached agreement with Primera Gold. They are appealing for the President’s intervention to address and contain the situation.

DECLARATION OF MINING COMPANIES PARTNERS OF SAKIMA SA IN THE PROVINCES OF NORTH-KIVU, SOUTH-KIVU AND MANIEMA
The public company SAKIMA SA (Société Aurifère du Kivu et du Maniema) and the private company under Emirati law, PRIMERA MINING LIMITED, signed on July 17, 2023 a joint venture agreement to guarantee the implementation of an industrial mining project.
However, on the date of its signature, this agreement covered areas covered by joint venture agreements and farm-out contracts that were still contractually and legally valid.
In addition, he was unaware that the mining deposits concerned in North Kivu, South Kivu and Maniema are no longer the exclusive property of SAKIMA SA, which it can dispose of as it sees fit, without consultation with its partners who own the titles.
Thus, the mining companies partners of SAKIMA SA and holders of the titles in question throughout the duration of their projects invite SAKIMA SA to return to reason and common sense by complying with the various legal instruments in its possession, agreements and freely signed contracts and to opt for a path leading to calming the storm it has sown.
They do not realize why SAKIMA SA, which has dozens of perimeters free of any commitment, has only targeted in its approach those for which it is legally bound.
They are launching an urgent and earnest appeal to His Excellency, the President of the Republic. They implore him to intervene in his capacity as the Guarantor of the Nation, the laws of the Republic, and the Supreme Magistrate.
His involvement is crucial to address the significant dispute that has arisen due to the aforementioned agreement. This dispute is already tarnishing the country’s image on both national and international levels, and it is discouraging national investors. These investors, who have contributed significantly to raising the DRC’s status as the world’s leading producer of coltan since 2018, deserve attention and support.
Finally, they take advantage of the opportunity to request a meeting with the Head of State and the government authorities in order to present to them the true situation and the prospects of their partnerships with SAKIMA SA.
