DRC Mining Sector Enters New Era with Worker Ownership Mandate

DRC Mining Reform: Minister Kabamba Enforces Mandatory 5% Congolese Worker Ownership in Mining Companies

In the Democratic Republic of Congo (DRC), the mining sector is entering a new phase of governance and accountability. Minister of Mines Louis Watum Kabamba has announced the strict enforcement of legal provisions that guarantee Congolese workers a direct stake in the capital of mining companies operating in the country.

Citing Article 71 bis of the Mining Code and Article 144 bis of the Mining Regulations, Minister Kabamba reiterated that it is legally mandatory for all mining companies to allocate 5% of their share capital to Congolese nationals. Historically, this requirement has often been neglected by operators in the sector.

To address this longstanding gap, the Ministry of Mines is now demanding that companies already in compliance provide documentary proof of adherence.

Companies that have yet to meet the obligation will be granted a final grace period until July 31, 2026, after which legal sanctions will be applied without exception.

This decision represents a turning point in the governance of the DRC’s mining industry. By enforcing worker ownership, the government formally recognizes Congolese workers as active economic participants, ensuring they benefit not only from employment but also from the value generated by the country’s natural resources.

Through this measure, Minister Kabamba underscores the Congolese state’s commitment to economic justice and national sovereignty in the mining sector.

“The DRC’s minerals must first and foremost benefit the Congolese people,” the Minister emphasized, highlighting the government’s determination to uphold the law and sustainably rebalance the benefits of mining.

This reform marks a significant step toward a more equitable and transparent mining industry, positioning Congolese workers as integral stakeholders in the country’s resource wealth.
