DRC President Urges Mining Companies to Establish Provincial Head Offices
The President of the Republic, Félix Tshisekedi, is determined to see the mining companies respect their legal obligation to erect the building housing their head office in the capital of the province of exploitation. This is what emerges from his communication during the Council of Ministers on Friday July 14, 2023.
In accordance with article 197 of the Mining Code in force, each “holder of a mining exploitation right is required to construct a building housing his head office according to the norms of international standards in the capital of the province of exploitation. within five years from the date of issue of the title.
In addition, article 393 bis of the Mining Regulations specifies that the budget allocated to the construction of this building must correspond to 1% of the investment budget contained in the feasibility study.
Unfortunately, it appears from a mission report commissioned by the Presidency of the Republic in June 2023 in the Provinces of Haut-Katanga and Lualaba that certain mining companies do not fulfill this legal obligation.
In order to ensure compliance with the Mining Law in this area and thus enable the companies concerned to contribute to the modernization of real estate infrastructure in the mining provinces, the Head of State instructed the Minister of Mines to “remind all companies concerned, this legal obligation while sending them a formal notice, and this, in accordance with article 566 of the Mining Regulations”.
