Zambia Cancels Mining Rights Over Non-Compliance
In compliance with Section 72 of the Mines and Minerals Development Act No. 11 of 2015, the Mining Licensing Committee (MLC) has taken decisive action at its 78th meeting to cancel certain mining and non-mining rights.
These cancellations stem from non-compliance with the conditions stipulated in the grant of these rights, as clearly outlined in default notices circulated on October 24, 2023.
Despite receiving these notices, the affected parties failed to take adequate remedial measures to address the Committee’s concerns satisfactorily.
The cancellation of these rights is in accordance with the provisions set forth in Section 72 of the Mines and Minerals Development Act No. 11 of 2015.
As stipulated in Section 97 of the same Act, mining and non-mining right holders who feel aggrieved by the decisions of the Mining Licensing Committee have the opportunity to appeal to the Honorable Minister of Mines and Minerals Development within thirty (30) days of receiving this notice, which is dated April 2, 2024.
To ensure efficiency, all appeal letters must be submitted via email with a deadline of May 1, 2024. It is crucial to note that any appeals submitted after May 1, 2024, will be deemed null and void.
Furthermore, cancellation letters can be obtained from the Mining Cadastre Department, and copies will be electronically sent to the registered email addresses of the affected companies, commencing on April 2, 2024.
Companies that have recently updated or changed their email addresses are advised to promptly inform the department to ensure seamless communication.
The Mining Licensing Committee emphasizes the importance of adhering to the stipulated regulations and conditions governing mining and non-mining rights.
