ARSP Lifts Suspension on Subcontracting Inspection Missions in Several DRC Provinces

DR Congo’s ARSP Resumes Subcontracting Inspection Missions Across Key Provinces

The Regulatory Authority for Subcontracting in the Private Sector (ARSP) has announced the resumption of previously suspended inspection and control missions in several provinces of the Democratic Republic of Congo, including the city-province of Kinshasa, Kasai Oriental, Kongo Central, Lualaba, Haut-Katanga, Haut-Uélé, and Tanganyika.

According to a decision signed by the new management committee, only companies specifically grouped and listed in mission orders issued following this decision will be subject to inspection.

The ARSP also authorized its inspectors, operating under mission orders duly signed by the Director General, to request and review the financial statements of major companies.

These reviews will be conducted through an adversarial process, with inspectors required to prepare official reports of their findings after, where necessary, issuing observation notices to the companies concerned.

At the conclusion of each mission, the ARSP will conduct a systematic evaluation of the data collected on a company-by-company basis.

The objective is to compile statistics on access to subcontracting opportunities for companies with majority Congolese ownership and to assess the contribution of subcontracting activities to job creation.

The decision further states that all previous provisions contrary to the new directive are repealed, with the measure taking immediate effect from the date of signature.

The ARSP recalled that, in accordance with existing legal and regulatory frameworks, inspection missions had already been launched within major companies operating in several provinces.

However, these operations were temporarily suspended following changes within the institution’s General Directorate after a presidential decree referenced in the decision.

The authority emphasized that the continuation of these inspection missions will be carried out in consideration of the current business climate and in strict compliance with official service guidelines.

The operations will follow an organized and carefully planned approach, including risk mitigation measures, rigorous team selection, and a comprehensive review of previous inspection activities conducted within each targeted company.

Through this renewed oversight initiative, the ARSP aims to strengthen transparency and ensure compliance with subcontracting regulations while promoting greater participation of Congolese-owned businesses in the national economy.
